Shall The Social Insurance Contributions be Paid During the Unpaid Leave? Print E-mail
Leaves without pay shall only be granted on either the employee's or the employer's demands and approval of the other party. Leave without pay shall only be granted upon mutual agreement of both parties. If a confined women requests in written form the employer must grant her up six month's leave without pay at the end of 16 week's leave. Earnings taken as a basis for premium and insurance contribution to be paid are calculated taking wages the employees receive and working days of the employee into account.

The employee who is granted with leave without pay shall not receive any payments during that period.  As these days are not accepted as insurance premium days and there are no earnings that would be taken as a basis for premium, the insurance contributions shall not be paid during leave without pay. These are not considered as working days. An employee who has used unpaid leaves for rest or for any other reason within 120 days before his termination of employment shall not benefit fromunemployment compensation even though he meets other requirements as there has been deduction on his unemployment insurance premiums.
